Media conference statement by Ean Yong Hian Wah in Kuala Lumpur on Monday, 25th July 2011: Disappointment and disbelief over the RCI Report I wish to express my deep disappointment and disbelief over the RCI Report which concluded that Teoh Beng Hock's death was caused by committing suicide. Most Malaysians share the same disbelief and anger that Teoh's mind in a matter of hours could transform him from a low-risk group into a high-risk group as what stated in the RCI report. Such conclusion of the RCI is hardly believable to any reasonable people with reasonable minds. Indeed, this disbelief is also supported by the Malaysian Bar's statement that forensic psychiatrist Paul Edward Mullen did not conclude at all that Teoh committed suicide. Furthermore, the Malaysian Bar also noted that the joint expert psychiatric report of Dr Badiah Yahya and Dr Nor Hayati Ali had stated that there was a lack of information to determine Teoh's state of mind. Hence, the RCI report has no basis to point to suicide as the cause. Furthermore, I cannot accept what was described by the RCI that Teoh fell into a state of "extreme emotional conflict", "immense feeling of guilt", "losing all hope" and "succumbed to despair" as the MACC investigation shows there were no elements of corruptions and abused of powers on the part of Teoh and me. In fact, there are inaccuracies and inconsistencies in the RCI report contributed by different witnesses' testimonies during the RCI hearings: [108] ...Apparently, contractors and suppliers for the small projects (infrastructure) or programmes would go there(DAP Serdang Aman) to request for payment first since the District Ofiice or Land Office would take one to two months to process their claims... [109]...We are unable to comprehend here as to why a contractor or an agent undertaking a programme or carry out a small project(infrastructure) required the financial assistance of a political party... Witnesses comprise of Wong Hong Chae, Lee Wye Wing and I had clearly pointed out duringthe RCI hearings that there was no any advance payments from the DAP Serdang Aman to fund any of the small projects(infrastructure) which carried out in my constituency. It was DAP Serdang Aman Branch that most of time acted as the programmes co-organiser and it footed some of the bills. But unfortunately the RCI did not recognise the facts and came out with different statement in the report. [110] Further, Lee had subsequently provided to IO Shafik a number of receipts issued by the DAP for the reimbursement of the monies advanced after HQ had taken over the investigation of the case. But none of the receipts was an exact match to the amount reimbursed to the DAP as listed out in the first page of each of the exhibits... If we look at the written testimony by Acting Senior Superintendent Ahmad Shafik Abdul Rahman from MACC during the RCI hearings, it is totally a different scenario. IO Shafik(witness IW 50) told the RCI that his investigating results show the reimbursement and the receipts were match and projects are carried out: Mr. Awang Armadajaya: Empat-empat disiasat, ya. Ok. Sekarang ini, kita lihat I 206 A dahulu, ok. Adakah Encik Shafik memahami apa yang dicatat pada ini, hasil daripada siasatan. IW 50: Hasil daripada siasatan yang dijalankan. IW 50: Jumlah RM379.15 yang dicatatkan dengan DAP Serdang Aman adalah jumlah yang dibayar balik kepada DAP Serdang Aman. Mr. Awang Armadajaya: Untuk tujuan apa dibayar balik? IW 50: Sebagai wang pendahuluan, sebagai tuntutan melalui resit Mr. Awang Armadajaya: I see. Maksudnya, program ini telah didahulukan duit oleh DAP Serdang Aman RM379.15 dan bila tuntutan itu telah diperolehi daripada Kerajaan, maka ia dibayar balik? IW 50: Ya, Yang Arif. Mr. Awang Armadajaya: Ok. Y. A. Chairman: Adakah dokumen menyokong bayaran dahulu oleh DAP Serdang Aman? IW 50: Berdasarkan kepada dokumen di belakang, resit-resit itu, total amount keseluruhan resit jika ditolak dengan RM50.00 lebihan resit itu, jumlah dia adalah RM379.15. Y. A. Chairman: Tetapi, saoalan saya, yang itu soalan yang bukan kali pertama ditimbul, adakah itu dahuluannya, advancement? IW 50: Ya, Yang Arif. Y. A. Chairman: Oleh DAP ya? Tetapi, adakah apa-apa dokumen yang menyokong payment ini? Dato' Abdul Kadir Sulaiman: Bukti advance itu, ada tak? Y. A. Chairman: Bukti advance. IW 50: Resitlah, Yang Arif, resit. Mr. Awang Armadajaya: Ok, ada sebarang siasatan dibuat sama ada jumlah RM379.15 ini adalah komisen kepada DAP Serdang Aman? IW 50: Siasatan lanjut ada dilakukan dan mendapati ianya bukanlah komisen daripada kontraktor kepada DAP Serdang Aman. Why there are inconsistencies of the evidences between the proceedings and the RCI report? The RCI report is supposed to unlock the cause of his death but instead contributes to more questions and uncertainties of his death.
