H.S.(D) s or no titles whatsoever

DAP Selangor has formed a
special 7-person legal task force to look into the grievances of all the new
villagers and the two churches displaced or partly effected by Projek
Lebuhraya Penyuraian Trafik Jalan Linkaran Kajang (SILK).
The legal task force consists of
lawyers specialised in land matters and constitutional rights. They are Nge
Koo Ham, Nga Hock Cheh, Teoh Lib Peng, Uma, Kevin Rozario, Sarina Begum and
M.J. Palan (co-ordinator).
Initial study shows that all the
effected landowners, whether they possess Q.T.s, A.A.s. Hak Sementara or no
titles whatsoever, or whether the tenure of these titles were expired or
still left with whatever number of years, will still hold the rights to
demand for rightful compensation.
To date, only a handful of them were
given rightful and ample compensation under the Land Acquisition Act.
Majority of them were either given little compensation or "promised" to be
given some "saguhati" (consolation on humanitarian grounds). Some of
them were also "promised" to be given a piece of land, which they need to
purchase from the State Government. And a few receive zero compensation.
In a meeting yesterday, which was
chaired by Datuk George George, the Director-General of Lembaga Lebuhraya
Malaysia, I have pointed out various irregularities in compensation as well
as their land rights. The meeting was attended by the General Manager of
SILK, Seputeh MP Teresa Kok, Cheras MP Tan Kok Wai, Khong Chee Seng (DAP FT
Treasure),Long Chin Lai (Sg Chua Landowners Action Committee Chairman),
effected landowners and two of their legal councils.
It was agreed by all that a memorandum
detailing all the demands and rights of the effected residents will be
submitted to Datuk George by this Thursday, and the matter should be
resolved within two weeks to four weeks. Meanwhile, all demolition work
should be put on hold for at least two weeks, before reaching a new
resolution.
The residents were shocked to hear
from Mr Ang, the general manager of SILK, that the so-called piece of land
for new homes (2,500 sq ft or 3,500 sq ft?) "promised" by the local
representative Datuk Hor Hee Lee as part of the compensation package was
only a "cadangan" (suggestion). Nothing is concrete at this stage.
The residents were also shocked to
learn that the so-called postponement of eviction for another two months
obtained by Hor from SILK(reported in various newspapers last week) was also
untrue.
The Sg Chuah case is the first of its
kind in the country. The outcome will determine whether the rights of all
landowners in new villages throughout the country are protected or
