(i) being
fully aware of the unprecedented motion of the Selangor State Assembly (“SSA”)
on 1.8.2005 to further suspend the service of Sdr Teng Chang Khim, the
Opposition Leader of the SSA and State Assemblyman for Sungai Pinang, from
the service of the SSA for a period of 6 months with all his privileges and
allowances stripped of after serving the original 5 meeting days suspension
and thereafter another 1 year suspension with all his privileges and
allowances stripped of if he refused to apologise to the SSA at the end of
the 6 month suspension for his symbolic act of protest of throwing the
misprinted and void copy of the Standing Order into a waste bin against the
abuse of power and total disrespect of the Standing Order by the Speaker of
the SSA, Tan Sri Onn Ismail;
(ii) Being
fully aware of the blatant abuse of power by the SSA Speaker in invoking an
irrelevant provision under the emergency motion of the Standing Order
to reject in the Speaker’s Chamber an ordinary motion by Sdr Teng
Chang Khim, for which the Speaker had no such power to do so, in order to
prevent Sdr Teng from raising a no-confidence vote against the Menteri Besar,
Dato Seri Dr Mohd Khir bin Toyo;
(iii) Being
fully aware that the Selangor Barisan Nasional had always attempted to
prevent Sdr Teng Chang Khim from raising various issues on the malpractices
of the administration, the corrupt practices of the politicians and scandals
of the state administration headed by the Menteri Besar, Dato Seri Dr Mohd
Khir bin Toyo;
(iv) Being
fully aware that Sdr Teng Chang Khim had even been assaulted in the SSA
lobby by the Barisan Nasional state assemblyman in 1999 and that no action
had been taken against the assemblyman concerned for the offence which was
more serious than the symbolic act of protest by Sdr Teng;
(v) Noted
with regret that the motion to refer Sdr Teng Chang Khim to the Committee of
Privileges was not even seconded before it was tabled for debate and
decision;
(vi) Noted
with regret that the Committee of Privileges acted in breach of rule of rule
of law and rule of natural justice by not allowing Sdr Teng Chang Khim to
defend himself before the Committee of Privileges;
(vii) Noted with regret
that the Committee of Privileges had not conducted a proper inquiry in
accordance with the accepted practice whereby no witness was called,
no evidence was taken and no exhibit was tendered at the inquiry before the
Committee deliberated on the matter and made its decision;
(viii) Noted
with regret the attempt of the Selangor Barisan Nasional to refer Ms Loong
Meng Yee, a journalist from the Star, to the Committee of Privileges for
reporting in advance the purportedly embargoed report of the Committee of
Privileges on the issue of Sdr Teng Chang Khim on 31.7.2005;
thereby
RESOLVED
(i) To
condemn the Selangor Barisan Nasional under the leadership of Dato Seri Mohd
Khir bin Toyo for its political assassination and vendetta against Sdr Teng
Chang Khim for exercising his rights of freedom of speech in the Selangor
State Assembly meetings to expose the malpractices, corrupt practices and
scandals of the state administration;
(ii) To
condemn the Speaker of the Selangor State Assembly for his total disregard
of the Standing Order and blatant abuse of power in invoking an emergency
motion to reject a ordinary motion with the sole intent and
purpose of preventing Sdr Teng Chang Khim from raising a no-confidence
motion against the Menteri Besar;
(iii) To
condemn the Selangor Barisan Nasional for subjecting Sdr Teng Chang Khim to
multiple jeopardy by penalizing him 4 times for a single symbolic act of
protest, increasing from 3 days suspension, 5 days suspension, 6 months
suspension with privileges and allowances stripped of to 1 year suspension
with all privileges and allowances stripped of;
(iv) To
condemn the inquiry of the Committee of Privileges for its failure to adhere
to the principles of rule of laws and rule of natural justice by failing to
call for evidence in accordance with the accepted rules and practices in its
inquiry;
(v) To
seek international support for Sdr Teng Chang Khim by lodging a
representation and complaint to the Commonwealth Parliaments Association;
(vi) To
table a motion through the DAP members of Parliament condemning the
tyrannous and high-handed conduct of the Selangor Barisan Nasional State
Assemblymen to shut the opposition up in the Selangor State Assembly;
(vii)
To launch a nation-wide campaign in solidarity with and in
support of Sdr Teng Chang Khim;
(viii) To
give full support and to offer all possible assistance to Ms Loong Meng Yee
in her defence before the Committee of Privileges, if any. |
