The victory of the family of custodial death victim A Kugan a victory of people of Malaysia

We urge BN government not to appeal against the landmark decision of Justice Datuk VT Singham. Instead, we demand Home Minister Datuk Seri Zahid Hamidi and the Inspector-General of Police Tan Sri Khalid Abu Bakar (then Selangor police chief) to apologize to A Kugan’s family immediately and openly for wrongfully imprisoned Kugan, breaching their duty of care to Kugan, abusing the remand order on Kugan and their attempt to cover up the death, as found by judge VT Singham.

In fact, if Khalid Abu Bakar is a man of honour, he should immediately resign from his position as IGP. In attempting to cover up Kugan’s death, Khalid Abu Bakar has failed to correct his statement that Kugan died of pulmonary edema (fluid accumulation in lungs), despite a second autopsy report finding that Kugan had died of kidney failure as a result of his beatings.

Not only that, he also failed to investigate V Navindran for murder under Section 302 of the Penal Code or manslaughter under Section 304 but only "causing hurt to extort a confession". Khalid Abu Bakar should be held responsible for the fact the culprits that caused the death of Kugan are still walking free in this country.

The findings of KL High Court also imposing a question of credibility and capability of Attorney General of Malaysia, who should act independently and impartially to institute, conduct or discontinue any proceedings for an offence.

Why the AG did not insist that V Navindran to be investigate and prosecute for murder or manslaughter? Was the AG also involved in the covering up of the death of Kugan? Or he simply gave in to the then Selangor police chief?
