DAP shall abide and comply with the decision of the Kuala Lumpur High Court tomorrow

DAP shall abide and comply with the decision of the Kuala Lumpur High Court tomorrow on whether DAP can hold re-elections on Sunday 29 September 2013 through a National Special Congress, which is expressly provided for in the DAP Party Constitution. Should the High Court allow the injunction, then the National Special Congress can not proceed on Sunday to conduct re-elections.

DAP is shocked that the ROS director-general Datuk Abdul Rahman Othman continues to insist that the DAP has not complied with the directive to hold a National Congress. To date, he has only communicated through the press without any letter in writing. He has also behaved most unprofessionally and irresponsibly by refusing to give reasons for his decision on the holding of re-elections in writing, causing the DAP not to know what wrongdoing has the party committed.

Datuk Abdul Rahman should have read the DAP Party Constitution carefully that there is a specific clause that allows party elections of the Central Executive Committee(CEC) to be held through a Special Congress and not only through a National Congress. Under a Special Congress, a seven-day notice to delegates is sufficient but a minimum 10-week notice is required for a National Congress. DAP had given 3 weeks notice, which is more than the one week required for the Special Congress.

Clearly by denying that there is such a specific clause to hold party CEC elections in a Special Congress, the ROS is resorting to lies to help UMNO victimise the DAP for our historic victories in the recent general elections. How can ROS talk about upholding justice for all party members when the ROS does not respect the DAP party constitution which ROS had earlier approved?

DAP calls on party members to remain calm and accept any decision made by the High Court 11 am tomorrow in Jalan Duta. CEC members will also be present to allow a quick decision to be made following the outcome of the judgment made.
