The High Court today struck out my application to declare that the request by the incumbent Prime Minister, Ismail Sabri Yaakob, to His Majesty the Yang di-Pertuan Agong Al-Sultan Abdullah Ri’ayatuddin Al-Mustafa to dissolve Parliament is null and void.
The learned Judge opined that the court should not intervene in the matter as it’s within the exclusive sphere of Parliament and the Executive.
Ahmad Kamal Md Shahid also said Ismail Sabri did not need to consult the cabinet on such matters and that it’s solely his decision to make.
The High Court also allowed the defendants RM20,000 in damages.
I have instructed my lawyers to file an urgent appeal against this decision.
With the utmost respect to the learned Judge, and after having perused the grounds of judgment, I think that this decision places too much power on the Prime Minister.
I also feel that citizens should not be imposed with costs for bringing matters of public interest to the courts. I was surprised that the Defendants actually asked for cost of RM200,000 against me.
We will ventilate these points in the appeal.
I will continue to fight for what I believe is right in the interests of the rakyat.
