DAPSY Calls for Immediate Cessation of Sedition Act Investigation Against Journalist

1. DAPSY Malaysia supports the statement issued by Sdr Ramkarpal Singh, Chairman of the DAP’s National Legal Bureau, expressing grave concern over the investigation and arrest of journalist Rex Tan under the Sedition Act 1948.

2. It is important to note that Rex Tan has already issued an unconditional public apology and even resigned from his position. In light of these facts, the use of the Sedition Act and his arrest are unnecessary, disproportionate, and wholly uncalled for.

3. The Sedition Act 1948 is a colonial-era law that has long been criticised for suppressing freedom of expression, as it criminalises speech regardless of intent. Pakatan Harapan, as a major component of the Unity Government, has consistently and firmly opposed the use of such oppressive laws, and has pledged on numerous occasions to abolish them, including the abovementioned act, in line with democratic principles and human rights.

4. Given that the journalist has apologised and even resigned to take responsibility for his action, continuing to investigate the individual under the Sedition Act merely for a question raised at a public forum risks creating a chilling effect on journalists, academics, and members of the public. This would in turn undermine the Unity Government’s efforts to improve and strengthen press freedom.

5. Furthermore, the selective and inconsistent application of the Sedition Act only raises further questions which potentially deepen public distrust. There have been instances in the past where politically connected individuals made far more inflammatory and racially charged statements without facing similar legal consequences.

6. For instance, Pengkalan Chepa MP Ahmad Marzuk Shaary made similar remarks likening Malaysia’s situation to Palestine, yet faced no consequences, not to mention arrest by the authorities. In comparison, swift action was taken by the authorities to investigate and even arrest the journalist. Such disparity risks raising serious questions among the public about double standards and equality before the law.

7. DAPSY Malaysia therefore calls upon the PDRM to immediately cease any investigation against Rex Tan under the Sedition Act 1948. Also, we urge the government to demonstrate political courage and sincerity by moving decisively towards abolishing the Sedition Act in line with its reform agenda.

8. DAPSY believes that Malaysia is on track to deliver significant institutional reforms, and thus must remain steadfast and committed to the cause instead of regressing into a culture of fear and suppression.
