Five charges under OSA against Teacher thrown out by Seremban High Court

In 2014 teacher Subbrau was charged under the Official Secrets Acts for having in his possession in his hand phone five UPSR exam papers. Last year in April 2015, he was acquitted without his defence being called.

The prosecution(AG) appealed to the High Court Seremban. The appeal was led by DPP Nik Azhan Hakim bin Nik Mahmood. M. Kula Segaran appeared and argued for the accused? The case was heard and arguments was put before Judge Datin Siti Mariam for a period over three hours this afternoon.

The judge amongst others said that Sessions Court Judge Datuk Jagjit did not make a factual or material error. She agreed that the Deputy Prime Minister at that time, Tan Sri Muhiyiddin should have been called as a witness to prove the prosecutions case.

The teacher has undergone a lot of pain and suffering over the years, with a sword hanging above his head. Although he was acquitted by the Sessions Court last April, he is yet to be reinstated to his previous job. I urge the Attorney General not to appeal this case to Court of Appeal as this teacher has suffered enough. Outside the court, Subbarao expressed his intentions that if possible, he wants to go back to work tomorrow.

He could if had been found guilty by the court jailed for a maximum of 7 years per charge tootling 35 years!!

Up today less then 10 persons have been charged under the Official Secrets Act. Very rarely this act is used as the consequence is serious.
