How can DAP trust MCA to cooperate together to oppose PAS implementing hudud on Muslims in Kelantan when MCA defends UMNO for supporting the implementation of hudud and Dr Chua Soi Lek confirms MCA President Liow Tiong Lai’s reputation for cowardice and breaking of promises? DAP can not co-operate with a party that practices double-standards and takes a hypocritical stand in attacking PAS but defends UMNO vigorously when both PAS and UMNO supports the implementation of hudud in Kelantan.

To cover-up MCA’s lack of courage to criticise UMNO for supporting the implementation of hudud in Kelantan, MCA is relying on the mainstream media to distort and lie as well as question DAP for refusing to work with MCA to oppose PAS implementing hudud. The latest lie by MCA and the mainstream media is that DAP supports PAS implementing hudud on Muslims in Kelantan and Terengganu but not outside Kelantan and Terengganu.

This is a lie. DAP unequivocally opposes the implementation of hudud whether by UMNO or PAS, whether in or outside Kelantan, whether on Muslim or non-Muslims because it is unconstitutional. DAP had even severely reprimanded Tian Chua for making such a statement, who had then immediately retracted his remarks and claimed he had been misquoted by the Chinese mainstream media.

There cannot be two separate laws for criminal offences as it is a discrimination on ground only of religion and therefore, unconstitutional. As stressed the former Chief Justice, Tun Abdul Hamid Mohamad, hudud as a Federal criminal law must apply to all, Muslims and non-Muslims alike, because it is “criminal law” and not “offences relating to percepts of Islam” as provided by List II (State List) Ninth Schedule of the Federal Constitution. If it is made applicable to Muslims only, it would be contrary to Article 8 as it is a discrimination on ground only of religion and therefore, unconstitutional, null and void.

Former MCA president Dr Chua Soi Lek is correct in his analysis to Malaysiakini, that UMNO with the largest number of MPs(88) in Parliament, has the power to determine success or failure in PAS’ attempt to implement hudud in Kelantan. Chua expressed full agreement with DAP leaders who had pressed MCA to convince Umno not to support PAS implementing hudud, describing it as logical.

Has Liow followed up on Chua’s suggestion that the MCA president leads a delegation of representatives from Chinese-based parties in the BN to meet Prime Minister Najib Abdul Razak opposing the implementation of hudud and that such a move would run foul of the 1Malaysia concept? Has Liow pushed for a special BN supreme council meeting for this to be raised by BN component members, where a majority are non-Muslims?

Instead of following up on Chua’s suggestions, Liow and the mainstream media in calling for DAP to work with MCA. Both conveniently ignores the double-faced politics of MCA in refusing to criticise and oppose UMNO for supporting PAS implementing hudud in Kelantan. The mainstream media has also failed to criticise UMNO for instigating PAS to implement hudud on 27 March in Parliament and supporting its implementation.

Similarly, the mainstream media has deliberately forgotten that Liow has a infamous reputation of breaking his promises. Chua Soi Lek was the latest victim when Liow refused to abide by the written election pact made before last year’s MCA party elections. How can Malaysians trust a political party like MCA when its leaders are not even trusted by its past President and members?
