Wall Street Journal in early July reported that RM2.6 billion was deposited in bank accounts held by Najib. The prime minister has repeatedly denied using the funds for personal gain, but not receiving the money into accounts in his name.
It was said that the money was meant to be a political donation for Barison National to be used during Election 2013.
In a Mandarin interview with Cari.com, the former MCA president Chua Soi Lek confirmed that some of the RM2.6 billion was used to fund BN component parties, which was an unprecedented move.
BN Backbenchers’ Club (BNBBC) Chairman Shahrir Samad has also admitted that he was one of the beneficiaries and recipients from this political donation via personal accounts for the 13th General Election campaigning.
While a huge portion of the RM2.6 billion “donation” was from Middle East, RM42 million was actually from SRC International, a company owned by the Ministry of Finance.
However, Minister of Finance in a parliamentary reply dated November 16, 2015 claimed that Government-owned companies through Minister of Finance Incorporated and Government-linked companies (GLC) do not provide annual funds specifically for contributions to politicians or political parties. But, they can channel contributions to politicians or political parties in order to finance the implementation of specific projects, such as assistance to flood victims, schools’ sport activities, aid to orphans, single mothers and people with disabilities (OKU).
Since the purpose of donation is for charity and social welfare, it is evident that Najib has committed criminal breach of trust when he used the donation from SRC International for GE13 campaigning.
Section 405 of the Pecal Code says that “whoever, being in any manner entrusted with property, or with any dominion over property either solely or jointly with any other person dishonestly misappropriates, or converts to his own use, that property, or dishonestly uses or disposes of that property in violation of any direction of law prescribing the mode in which such trust is to be discharged, or of any legal contract, express or implied, which he has made touching the discharge of such trust, or wilfully suffers any other person so to do, commits ‘criminal breach of trust’.”
No right-minded Malayisians will believe that RM42 million from SRC International is for Najib to do charity. He is the Prime Minister and also Finance Minister of the country, who can hardly squeenze any time to answer any questions related to 1MDB and RM2.6 billion donation twin scandal in parliament. If the truth is so straight-forward and simple, why does it take Nik Faisal and Datuk Suboh, directors of SRC Internatioanl, to give their statement to MACC?
