This statement is made in reply to the allegation by Lee Guan Aik in a press conference yesterday that the Registrar of Society has confirmed him as DAP Kedah Chairman.
The DAP central executive committee (CEC) had on 30th September 2013 re-appointed Sdr Zairil Khir Johari as the party’s interim chairman of Kedah DAP following a re-election of the CEC which was held on the 29th September 2013. The CEC decided to re-appoint Zairil Khir Johari as the Interim chairman and the decision of the CEC was done in accordance with Clause XIV of the Party’s constitution which stipulates as follows :-
Section 11 : “The Central Executive Committee shall have to power to dissolve any State Committee if it is satisfied that the continued functioning of the Committee will be detrimental to the interest or good image of the Party”
Section 12 : “In the event of dissolution, the Central Executive Committee shall form an Interim State Committee soonest possible within six month after such dissolution and appoint its official and members”
The CEC have decided to endorse its decision to appoint Sdr Zairil Khir Johari as Interim Chairman of DAP Kedah and the committees’ appointment. There should be no doubt as to the said appointment as it was within the powers and purviews of the Central Executive Committee.
We are indeed perplexed and surprised that Registrar of Society (ROS) deemed fit to issue the letter challenging or disputing the validity of the CEC which was duly elected by its members in a Special Congress held. The ROS should not interfere with the decision making process of the Party.
Furthermore, the conduct of the ROS was most unprofessional as we did not receive any letters from ROS pertaining to this matter until today.
I’ve requested DAP Legal Bureau Chairman Gobind Singh to immediately look into this matter and if necessary, legal action will be initiated to challenge the unlawful decision of the ROS.
