UPSR leakage -Investigation Officer’s evidence given in Seramban court and Kuala Kangsar court differs

Today the Kuala Kangsar Court heard one wittiness on the on going case against teacher UMA MAGESWARI A/P PERIASAMY @ MAYANDY 28 YEARS OLD a teacher in a Tamil school.

She is charged for being in possession of UPSR Science paper.

Her defense is she did not ask for those documents but was independently sent to her in her WhatsApp group.

Deputy Public prosecutor (DPP) Yusaili Amer and Amiril are prosecuting before Sessions Judge Johari Bin Hassan.

Lawyers representing the accused were M. Kula Segaran, Augustine Anthony and N. Selvam

This case is regarding Uma Mageswari, a school teacher who is being charged with the UPSR 2014 examination leakage under the Official Secret Act. Today was the Continuous Hearing for this particular case whereby a witness have been examined.

The first witness for today was ASP Irwan Bin Saini, 41 years old who is in charged for the Bahagian Perundangan Siasatan Jenayah from IPD Putrajaya. He stated that after seeing the police report, he was interested in investigating this matter. He said that being an Investigating Officer, he has carried out the “investigation thoroughly”. However when question did he investigate who had originally and the first person who had leaked the UPSR 2014 questions he said he unable to confirm who was the culprit who sent the Whatsapp. Counsel chided him and asked how can he consider himself a through investigator? To this he keep quiet.

Further when asked as an Investigation Officer(IO) he investigated the first person who WhatsApp the UPSR question of 2014 the IO said it was a teacher from Tampoi by the name of Zulfikili. The IO took a statement but did not arrest Zulfikili and neither was he charged. When asked why Zulifikini was NOT charged but Umma mageswari was charged the IO kept quiet. I said what type of IO he is and this a clear case of “pilih kasih” to charge a wrong doer.

Furthermore he also stated that Inspector VIkneswaran carried out arrest of Uma Mageswari.

He also said that the watikah (A Minister Under section 2b can give a certificate to a public office to classify a document as Top secret, Secret etc) was signed by Tan Sri Muhiyydin Yassin (then Minister of Education). However during intense cross examination by lawyers Kula and Augustine Anthony he said that he was unsure whether the signature in the Watikah was that was his signature or a mere cop.

In relation to the amended signatures in the Buku Daftar Rahsia Rasmi Dr. Naimah signed upon request of the Investigation office ASP Irwan at police Putra Jaya . However during the cross examination it was learnt that there was a material contradiction in his statement sd at Seremban court and also today. In Seremban court the investigation officersaid that the signature was there for correction of the question papers which were sent to the Government printers and returned. ( The Government printer had given evidence before that the UPSR papers would be sent to him to print a draft and then he will sent back to Dr Nanimah for proof reading which will take place few times)

Today the investigation officer is changing his evidence in that he is saying the amended signatures were for UPSR examination paper was leaked (bochor) and not for amendments.

Another witness Yusran Shah bin Mohd Yusof then Setiausha Sulit Kanan kepada YB Menteri Pendidikan was absent as he had gone to perform Haj. In Seremban this office had given evidence to say Tan Sri didi not sign the Watikah but he used a ready made signed chop to affix on the Watikah.

Finally there was question on who should certified the Notes of Evidence of the Seremban case in order to be in line with the proceedings. Therefore the hearing has now been fixed for the 5th and 6th November 2015
