I wish to announce that the High Court Shah Alam Judge Dato’ Haji Ahmad Nasfy bin Haji Yasin today allowed with costs an application by the Government of Malaysia to strike out the civil suit filed against it by Shaaribuu Setev and 3 others in relation to the murder of Altantuya Shaaribuu.
The said application to strike out was strongly opposed by Mr. Shaaribuu and the other Plaintiffs to the said suit and the decision of the said High Court today that the Plaintiffs said suit against the Government of Malaysia does not disclose a reasonable cause of action is most disappointing.
As such, we will proceed to file an appeal against the said decision to the Court of Appeal on behalf of the family of Altantuya as, while we respect the said High Court decision, we cannot agree with the same.
I further informed the court that the Plaintiffs intend to appeal its said decision to the Court of Appeal and the court has fixed 23.11.2017 as the next mention date pending the said proposed appeal.
It should be further noted that the Plaintiffs’ suit against Sirul Azhar Umar, Azilah Hadri and Razak Baginda remains unaffected by this decision and will proceed after the disposal of the said proposed appeal.
