The United States Supreme Court’s 6-3 decision to dismantle the legal basis of the Trump administration’s unilateral tariffs represents a watershed moment for global trade and a significant strategic opportunity for the Malaysian government to reassess our current trajectory. While we recognize the Ministry of Investment, Trade and Industry’s (MITI) tireless efforts to provide certainty for our exporters through the Agreement on Reciprocal Trade (ART), we must now confront the reality that the reciprocal foundations of this deal have been fundamentally altered by the highest court in the United States. The 25% tariff threat by the USA, which is the very “sword of Damocles” that compelled Malaysia to the negotiating table, has been declared a legal nullity.

We must demonstrate the political maturity to pause and pivot when the global landscape shifts so dramatically. To proceed with the ratification of the ART in its current form would be to ignore a massive change in the rules of the game, potentially locking Malaysia into long term procurement and resource commitments in exchange for relief from a tariff that the U.S. Executive no longer has the constitutional power to enforce. We must avoid the trap of policy inertia and instead take the lead in ensuring that our trade agreements are built upon stable, legally binding congressional frameworks rather than vulnerable executive orders. Malaysia must not be seen as a nation that accepts an unequal bargain when the legal justification for that bargain has evaporated overnight.

I therefore call upon the government to exercise principled caution by suspending the ratification process of the ART to allow for a comprehensive legal and economic review by our experts. This is the time for the Unity Government to show its mettle by demanding a New Deal that reflects this new legal reality, one that prioritizes the return of duties already paid by our hardworking Malaysian exporters and ensures our sovereignty over critical industries remains intact. Let us move forward with a clear conscience and a steady hand, ensuring that any agreement we sign is not merely a reaction to external pressure, but a proactive step that truly serves the long term prosperity and dignity of all Malaysians.
